AVI9 TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your access to and use of the AVI9 website, mobile application, platform, software, content, features and related services collectively referred to as the "Services".

In these Terms, "AVI9", "we", "us" and "our" refer to Pulsar Global Holdings Limited.
By creating an account, accessing or using the Services, you confirm that you have read, understood and agreed to these Terms and our Privacy Policy.
1. About AVI9
AVI9 is a digital platform designed primarily for aviation professionals. Depending on the location and availability of features, AVI9 may enable eligible users to:
- Search for participating merchants, services and offers;
- Discover aviation-industry discounts and benefits;
- Search by country, city, district, category or proximity;
- View merchant locations through map-based services;
- Use location-based features;
- Submit or suggest merchants;
- Maintain an AVI9 user or aviation professional profile;
- Access other aviation-related lifestyle and travel features that may be introduced from time to time.
AVI9 is an independent platform. We are not an airline, airport, aviation authority, employer, labour union, travel agency, tour operator, bank, payment provider or representative of any merchant unless expressly stated otherwise.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services.
Certain offers or features may only be available to verified aviation professionals, employees of participating organisations or other approved categories of users.
You must provide accurate and current information regarding your identity, aviation employment, employer, job role, home base or other eligibility criteria when requested.
We may approve, reject, suspend or withdraw verification where:
- The information provided is incomplete, inaccurate or misleading;
- A document appears altered, expired or invalid;
- Your aviation employment or eligibility cannot be confirmed;
- We reasonably suspect fraud, account sharing or misuse;
- Your eligibility has ended.
Verification by AVI9 does not constitute confirmation by an airline, airport, employer or government authority.
3. Account Registration
You may be required to create an account to use some or all of the Services.
You agree to:
- Provide accurate, complete and current information;
- Keep your login credentials confidential;
- Not share, sell, transfer or lend your account;
- Notify us promptly if you suspect unauthorised access;
- Update your account information when it changes;
- Accept responsibility for activities conducted through your account, except where caused by our own breach of applicable law.
We may require additional verification before restoring access to an account.
Each person may maintain only one personal account unless AVI9 expressly permits otherwise.
4. Aviation Professional Verification
AVI9 may request reasonable evidence that you are currently or formerly employed in the aviation industry or otherwise qualify for a particular benefit.
Verification information may include:
- Employer or airline name;
- Work email address;
- Job title or department;
- Employee or staff identification number;
- Home base;
- A photograph or copy of an aviation employee card, staff badge or equivalent evidence;
- Other supporting information reasonably necessary to prevent fraud.
You must not upload identification documents belonging to another person.
You may redact information that is not reasonably required for verification, unless the information is necessary to establish eligibility.
AVI9 may display a verification status, eligibility status or digital aviation profile. Such status is for AVI9 platform purposes only and must not be treated as an official employment credential, security pass, airport access card, travel document or government identification.
5. Merchant Listings and Offers
Merchant listings, discounts, benefits, promotions, descriptions, opening hours, photographs, prices, locations and availability may be supplied by merchants, users, public sources or third-party service providers.
Although AVI9 may review merchant information, we do not guarantee that every listing or offer is accurate, complete, available or current.
Merchants may establish their own conditions, including:
- Eligible aviation employee categories;
- Required proof of employment;
- Participating branches or locations;
- Valid days and times;
- Minimum spending requirements;
- Blackout dates;
- Excluded products or services;
- Reservation requirements;
- Maximum redemption frequency;
- Whether an offer can be combined with another promotion.
You are responsible for checking the merchant's current terms before making a purchase, reservation or journey.
A merchant may request valid evidence of aviation employment before applying a discount. AVI9 does not control the merchant's final eligibility decision.
6. Transactions with Merchants
Unless expressly stated otherwise, AVI9 is not a party to any purchase, booking, reservation, payment, refund or other transaction between you and a merchant.
Any transaction is entered into directly between you and the relevant merchant.
The merchant is responsible for:
- Its products and services;
- Pricing and taxes;
- Product quality and safety;
- Reservations and availability;
- Customer service;
- Refunds, cancellations and warranties;
- Compliance with local licensing and consumer protection laws;
- Honouring or refusing an offer in accordance with its stated conditions.
Disputes concerning a merchant transaction should first be raised directly with the merchant. AVI9 may provide reasonable assistance but is not required to resolve or reimburse merchant disputes.
7. Free and Paid Services
AVI9 registration and access to standard platform features are currently offered free of charge unless otherwise stated.
We may introduce optional paid features, subscriptions, premium services or transaction-based services in the future. Before charging you, we will clearly disclose the relevant price and applicable terms and obtain any legally required agreement.
Merchants may charge users directly for products and services purchased from them.
8. Location Services and Maps
Certain features may request access to your device location.
Depending on your device settings, AVI9 may request your current location when you log in, open the Services or use a location-based feature.
You can deny or disable location permission through your device settings, but some features may not function properly.
Location, distance, map, route and nearby-merchant information may be approximate or provided by third-party map services.
You must not rely on AVI9 location or map information for:
- Aircraft operations;
- Flight planning;
- Dispatch or crew scheduling;
- Airport security access;
- Emergency navigation;
- Immigration or visa decisions;
- Regulatory compliance;
- Safety-critical decisions.
You are responsible for verifying routes, opening hours, local conditions and access requirements.
9. Merchant Suggestions and User Submissions
Users may be permitted to suggest merchants, submit corrections, provide feedback, upload images or contribute other content.
You confirm that:
- Your submission is accurate to the best of your knowledge;
- You have the right to submit the content;
- The content does not infringe intellectual property, privacy or other rights;
- The content is not fraudulent, defamatory, unlawful, misleading or harmful;
- The content does not contain malicious software or hidden tracking mechanisms.
Submitting a merchant does not guarantee that the merchant will be contacted, approved or published.
We may review, edit, reject, remove, suspend or retain submissions for moderation, fraud prevention and record-keeping purposes.
You retain ownership of your original content. By submitting content to AVI9, you grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, adapt, translate, display and use that content for operating, improving and promoting the Services.
This licence ends when the content is deleted from our active systems, except where continued retention is reasonably necessary for legal, security, backup, fraud-prevention or dispute-resolution purposes.
10. Acceptable Use
You must not:
- Create an account using false identity or employment information;
- Upload forged, stolen or altered employment documents;
- Impersonate another person, merchant, airline or organisation;
- Share an AVI9 account or verification status with another person;
- Use another person's discount eligibility;
- Misrepresent your employment status to obtain a benefit;
- Scrape, harvest, copy or systematically extract AVI9 data;
- Use bots, automated scripts or unauthorised software;
- Attempt to bypass security, verification, access or usage controls;
- Reverse engineer, decompile or interfere with the Services;
- Upload malware, harmful code or misleading links;
- Collect personal information about other users without authority;
- Use the Services for unlawful, discriminatory or fraudulent purposes;
- Publish false or malicious statements about merchants or users;
- Resell or commercially exploit AVI9 content without permission;
- Use AVI9 branding in a way that suggests an unauthorised partnership;
- Interfere with the normal operation of the Services.
We may investigate suspected misuse and cooperate with merchants, employers, service providers or authorities where reasonably necessary and legally permitted.
11. Merchant and Business Accounts
Merchants, business representatives and data-entry personnel may be subject to additional agreements, merchant terms, platform rules or administrative permissions.
Where a separate Merchant Agreement or commercial agreement applies, that agreement will govern merchant participation, listing approval, discounts, use of trademarks and related obligations.
These Terms do not replace any separately signed Merchant Agreement.
12. Intellectual Property
The Services and all related intellectual property, including the AVI9 name, logo, design, software, databases, graphics, text, layout, features and platform content, are owned by or licensed to Pulsar Global Holdings Limited.
Except where expressly permitted, you may not copy, modify, reproduce, publish, distribute, sell, license or commercially exploit AVI9 intellectual property.
You are granted a limited, personal, revocable, non-exclusive and non-transferable right to use the Services in accordance with these Terms.
No ownership rights are transferred to you.
13. Third-Party Services and Links
AVI9 may contain or use third-party websites, map services, social-media services, analytics tools, cloud infrastructure, booking links or merchant platforms.
Third-party services are governed by their own terms and privacy policies.
We are not responsible for the availability, content, security, accuracy or practices of third-party services.
A link or integration does not necessarily mean that AVI9 endorses or guarantees the relevant third party.
14. Service Availability and Changes
We may update, modify, suspend or discontinue any feature or part of the Services.
We do not guarantee that the Services will always be uninterrupted, secure, error-free or available in every country.
Listings and features may vary by country, city, employer, merchant, device or user eligibility.
We may conduct maintenance, security updates, testing or emergency suspension without prior notice where reasonably necessary.
15. No Aviation, Travel or Professional Advice
Information provided through AVI9 is for general discovery and convenience purposes.
AVI9 does not provide aviation operational advice, legal advice, immigration advice, financial advice, medical advice or official travel authorisation.
No information displayed on AVI9 should be used as a substitute for information from an airline, airport, aviation authority, employer, merchant or government agency.
16. Suspension and Termination
You may stop using AVI9 at any time and may request account deletion through the available account settings or by contacting support@avi9.club.
We may restrict, suspend or terminate your account where:
- You breach these Terms;
- You provide false or fraudulent information;
- You misuse merchant offers;
- Your account creates a security or legal risk;
- We are required to do so by law or a competent authority;
- Your continued access may harm AVI9, its users, merchants or partners.
Where reasonably possible, we may provide notice and an opportunity to respond. Immediate action may be taken in cases involving fraud, security, unlawful conduct or serious risk.
Termination does not affect rights and obligations that arose before termination.
17. Disclaimers
To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.
AVI9 does not guarantee:
- The accuracy or completeness of merchant information;
- That a merchant will honour a listed discount;
- The availability, quality or safety of merchant products or services;
- That all merchants have been independently inspected;
- That the Services will meet every user's requirements;
- Continuous or error-free operation;
- That user-submitted information is accurate;
- Any particular financial saving, benefit or result.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
18. Limitation of Liability
To the maximum extent permitted by applicable law, AVI9 and Pulsar Global Holdings Limited will not be liable for indirect, incidental, special, punitive or consequential losses, including loss of profit, opportunity, data, goodwill, business, travel arrangements or anticipated savings.
We are not responsible for loss arising from:
- A merchant's refusal to provide a discount;
- A merchant's product, service, conduct or closure;
- Inaccurate merchant or map information;
- Your failure to verify an offer;
- Unauthorised access caused by your failure to secure your account;
- Third-party platforms or services;
- Events outside our reasonable control.
To the maximum extent permitted by law, our total aggregate liability arising from or relating to the Services will not exceed the greater of:
- The amount you paid directly to AVI9 for the relevant Services during the 12 months before the event giving rise to the claim; or
- USD 100.
This limitation does not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot legally be limited or excluded.
19. Indemnity
To the extent permitted by law, you agree to indemnify Pulsar Global Holdings Limited against reasonable losses, liabilities, claims and costs arising from:
- Your unlawful use of the Services;
- Your material breach of these Terms;
- Fraudulent information or documents submitted by you;
- Your infringement of another person's rights;
- Content submitted by you.
This provision does not require you to indemnify us for losses caused by our own fraud, wilful misconduct or breach of applicable law.
20. Privacy
Our collection and use of personal data are governed by the AVI9 Privacy Policy.
By using the Services, you acknowledge that your personal data may be processed as described in that policy.
21. Changes to These Terms
We may update these Terms to reflect changes in the Services, law, security requirements or business operations.
Material changes will be communicated through the Services, by email or through another reasonable method.
The updated Terms will show a revised "Last Updated" date.
Where required by law, we will obtain your consent before material changes take effect.
Continued use after the effective date of updated Terms constitutes acceptance where legally permitted.
22. Governing Law and Jurisdiction
These Terms are governed by the laws of the Hong Kong Special Administrative Region.
Subject to any mandatory consumer rights or local laws that apply to you, the courts of Hong Kong will have exclusive jurisdiction over disputes arising from these Terms or the Services.
Nothing in this section removes any mandatory rights you have under the laws of your country of residence.
23. General Provisions
If any provision is found invalid or unenforceable, the remaining provisions will continue in effect.
Our failure to enforce a provision is not a waiver of that provision.
You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations as part of a merger, restructuring, financing, sale of business or transfer of the AVI9 platform, subject to applicable law.
These Terms, together with the Privacy Policy and any additional terms applicable to a feature, constitute the agreement between you and AVI9 concerning the Services.
24. Language
These Terms may be translated into other languages.
Where legally permitted, the English version will prevail if there is any inconsistency between translations.
